Sweet Pea Learning's Privacy Policy is to inform you of how we collect, use, share, and protect information about you. When you interact with Sweet Pea Learning through our online store, websites, products, and services, you consent to the use of information that is collected or submitted as described in this Privacy Policy. You also expressly consent to the sharing of your personal information with our third-party service providers.

TYPES OF INFORMATION COLLECTED

Categories of Personal Information Collected

We may collect personal information that you voluntarily provide when you visit one of our website and place an order online, send information via mail, save your information with us online, contact us with a question or concern, or participate in a contest, promotion, or survey. In particular, we have collected the following categories of personal information from consumers within the last three (3) months:

  • Identifiers: First and last name, e-mail, address, or phone number
  • Commercial information: Registry or list information; purchase information such as shipping address, credit card number, and history of purchases you make online.
  • Sensory data: Audio, electronic, visual, or similar information

  • Internet or other electronic activity: Clicking behavior, browsing history, search history, reviews, information on your interaction with our website, or advertisement
  • Inferences drawn from other personal information: Special designations (e.g., parent or teacher) and shopping preferences such as grade level or age group

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from the consumer—for example, from forms you complete or products and services you purchase, when you place an order online we save your information with us online. If you contact us with a question or concern, participate in a contest, promotion or survey, or create a registry all information gets stored.
  • Indirectly from the consumer or through automatic data collection technologies such as cookies
  • From third parties such as advertising and marketing partners, public databases and social media platforms, and data brokers

HOW WE USE INFORMATION

Business Purpose & Use of Personal Information

We collect and use the above categories of personal information for the following business or commercial purposes. Specifically, this information was collected and used for the following business purposes in the preceding twelve (12) months:

  • To process your requests, purchases, transactions, and payments, and to prevent transactional fraud
  • To communicate information about our products, services, events, and contests, or for other promotional purposes
  • To provide consistent, personalized services, experiences, and advertisements
  • To manage your Sweet Pea Learning account
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and to monitor and improve our responses
  • To personalize, develop, and improve our websites, products, and services
  • To maintain our customer sale purchases
  • To create gift registries
  • To improve our products and product design, protect the security of our websites, enhance your shopping experience, and improve the functionality of our websites
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations

COOKIES, ADVERTISING, AND ONLINE TRACKING

Like all retail websites, we use cookies to store your preferences and to help us remember you as a user when you make return visits to our websites. We also use cookies to record session information, such as items saved to your shopping cart(s), the different web pages you view on our websites, and the last website you visited prior to visiting ours. We may also use technologies, such as our own cookies, to provide you with personalized online display advertising tailored to your interests. 

We may engage the services of third parties to collect and use anonymous information about your visits and interactions with our websites through technologies such as cookies to personalize advertisements for goods and services. 

Some third parties involved in advertising operations may maintain their own proprietary consumer databases that allow them to personally identify or track website visitors. Other third parties have proprietary technologies to determine what additional devices you may use, on which they can display relevant advertisements.

Do Not Track. “Do Not Track” is a privacy preference you can set in your Internet search browser that sends a signal to a website that you do not want the website operator to track certain browsing information about you. However, because our website is not configured to detect Do Not Track signals from a user’s computer, we are unable to respond to Do Not Track requests. We track website users over time and across third-party websites.

SOCIAL NETWORK WIDGETS

Our websites may include social network or other third-party plug-ins and widgets that may provide information to their associated social networks or third parties about your interactions with our web pages that you visit, even if you do not click on or otherwise interact with the plug-in or widget. Information is transmitted from your browser and may include an identifier assigned by the social network or third party; information about your browser type, operating system, device type, and IP address; and the URL of the web page where the plug-in or widget appears. If you use social network tools or visit social networking sites, you should read their privacy disclosures to learn what information they collect, use, and share.

LINKS TO THIRD PARTIES’ SITES

Our websites may link to other sites that we do not control. In addition, you may have visited our websites through a link or a banner advertisement on another site. In such cases, the site you linked from may collect information from people who click on the banner or link. These other sites are governed by their own privacy policies. Be sure to review these privacy policies when visiting such sites to see how they collect and use this information. We are not responsible for the content or privacy practices of such third parties’ sites.

CHILDREN’S INFORMATION

We do not intend for our websites to knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow minors under the age of 13 to disclose their personal information to us through our websites. Our websites are directed to individuals who are 18 years of age and older. If you are a parent or a guardian and believe that we might have any information about your child who is under the age of 13, please contact us (support@sweetpealearning.com)

YOUR CHOICES AND ACCESS REQUESTS

At any time, you can review and modify the information you gave us during your account registration process. Just go to your account page. There, you have the option of looking over the information that you gave us and changing or updating that information if desired.

You may “opt out” from receiving text messages, advertisements, direct mail, and other promotional communications from us by contacting Customer Service. You can do do so  by “unsubscribing” once you receive an e-mail from us, or by contacting us directly. Please allow our system to process your request after you have submitted your e-mail address to “unsubscribe.”

UPDATES TO THIS POLICY

We reserve the right to amend our Privacy Policy at any time, so we encourage you to review it periodically. If we make any material changes in the way we collect or use your personal information, we will notify you by sending you an e-mail at the last e-mail address you provided us and/or by prominently posting notice of the changes on our websites. Changes will be effective immediately upon posting to the sites and will apply to your use of the sites after the “effective date” listed above.

SECURITY

No system for safeguarding personal or other information is 100% secure, and even though we have taken steps to protect your personal information from being intercepted, accessed, used, or disclosed by unauthorized persons, we cannot entirely eliminate security risks associated with personal information. However, we take a number of steps and implement electronic means to safeguard the security of personal information obtained through the sites. For example, we use SSL (Secure Sockets Layer)—the industry standard in online encryption technology—to ensure that your personal and credit card information remains secure. SSL encryption allows you to shop with confidence, knowing that only you and Sweet Pea Learning have the ability to access your information.

Whenever you access a secure page on our sites, the information you send is immediately encrypted for your protection.

APPLICABLE LAW

This policy is governed by the internal substantive laws of California without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within the state of California. If any provision of this policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this policy, which shall remain in full force and effect.

CALIFORNIA PRIVACY RIGHTS

If you are a California resident, you may have additional privacy rights. The following California-specific rights supplement and amend the information contained in our Privacy Policy as set forth above.

“Shine the Light” Law

California residents who have an established business relationship with Sweet Pea Learning may request a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties.

California Consumer Privacy Act

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in this Privacy Policy and applies solely to visitors, users, and others who reside in the state of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

The CCPA and California Consumer Rights

Effective January 1, 2020, California consumers have specific privacy rights governed by the CCPA. Subject to certain exceptions, these rights include:

Right to Request Information

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • Our business or commercial purpose for collecting or selling that personal information
  • The categories of third parties with whom we share that personal information
  • The specific pieces of personal information we collected about you (also called a data portability request)
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • Categories of personal information that were sold and the categories of third parties to which each was sold; and
    • Categories of personal information that were disclosed for a business purpose and each category of third parties to which each was shared

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Right to Opt Out

You have the right to opt out of the sale of your personal information.  Or by making a request to Customer Service (support@sweetpealearning.com).

Exercising CCPA Rights

You or an authorized agent may submit a request to enact any of the above rights. To submit a request under the CCPA, please call or e-mail Customer Service (support@sweetpealearning.com).

In order for us to process the request, we first need to verify your identity as one of our consumers, or that you are a person duly authorized to make the request on behalf of one of our consumers. As a consumer, you will be required to provide your name, mailing address, e-mail address, and phone number. Authorized agents will be required to provide this information about the consumer who is the subject of their request and information that demonstrates their authority to submit the request on behalf of the consumer. We will then compare the information provided against our records. We may require additional information to verify your identity before responding to a CCPA rights request. We reserve the right to only respond to verifiable consumer requests. If we cannot verify your identity, you will receive an e-mail explaining that your identity could not be verified. We will only use the personal information you provide in a verifiable consumer request for the purpose of verifying the requestor’s identity or authority to make the request.

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
